Your loved one has passed and there is no will. This can be a confusing time and you may have lots of questions. Getting those questions answered by an attorney at the beginning of the process may help to make the process go much more smoothly.



When a person dies and doesn’t have a will, what happens to their property?


In Oregon, if a person passes away without a will, or if they had a will but it cannot be located, then the court will put a standard will in place for them using the laws of Intestacy. The laws of intestacy will govern who can be appointed as personal representative of the estate, who will inherit what property, and in which order bills get paid
